The Terms of Service and Non-Disclosure Agreement papers are relatively generic, and relatively standard for what they are. They're vague enough to cover a wide breadth of consequences (ie, Terms of Service 17.204 "Players may feel some side effects from sustained usage of Virtual Reality technology;" this may potentially cover anything from discomfort to seizures).
A terms of service like this can't viably cover breaches of privacy or targeted harassment, but proving these things is also in itself a challenge. Because (as far as I'm aware) no recordings of my conversation with my brother exist, this being why CC Corp should not be able to produce an item with transcriptions of these conversations, I cannot prove that these conversations have been transcribed onto this item. Similarly, you may need to prove targeted harassment or discomfort in your case (or explain why you did not swap out armor sets for one that is more comfortable).
While I posited that this information has been accessed directly from our minds, I would also need to prove this is possible, as this technology does not currently exist (as far as the public, and therefore the legal system, is aware). CC Corp would have to confirm the existence of this technology, and they are unlikely to do so if they are knowingly capable of it.
And if there is an internal actor utilizing this technology without the representative forces of CC Corp's knowledge, that further complicates litigation efforts.
And by all technicality, CC Corp is likely not yet in violation of writs issued by any ethical committees. This project likely received approval from its home country's Board at several points in the planning, building, and execution of Fragment. Not only are forbiddances generally established retroactively, the general rate of technological advance exceeds the pace at which a Board operates. CC Corp's technology is even further ahead of the pack.
Very likely, should our experiences ever become public (and they potentially never be, depending on interpretation of the terms set within the NDA we signed, and whether our future retellings gain public or legal traction), we may become basis for future rulings against certain uses for virtual reality technology. But we're currently in uncharted territory legally and ethically. It's the ideal stretch of time to experiment and research; you can gain funding, act on your directives and hypotheses, and publish your research or publicize your product. It would require an extensive media campaign to redact public perception of especially sensationalized findings, even if your research or product is later held in contempt.
It is, of course, not impossible to do something at this stage, legally. But it is rather challenging, as technological advancement moves quicker than any legal process.
